Terms of Service

1. Acceptance

By creating an account or using the Pilot-Next service (“Service”), you agree to these Terms of Service (“Terms”) on behalf of yourself and, where applicable, the organisation you represent (“Customer”). If you do not agree, do not use the Service.

2. The Service

Pilot-Next is a SaaS platform for general aviation groups: aircraft booking, flight logging, invoicing, and financial tracking. We grant you a limited, non-exclusive, non-transferable right to access and use the Service during your subscription term.

3. Accounts

• You must provide accurate registration information and keep it up to date.
• You are responsible for maintaining the confidentiality of your credentials.
• You must notify us immediately at contact@pilot-next.com if you suspect unauthorised access.
• One account per person. You may not share login credentials.
• You must be at least 18 years old to create an account.

4. Subscriptions and payment

Pilot-Next is offered on a subscription basis. Prices are in EUR and are displayed on the pricing page. Billing is managed through Stripe. By providing payment details, you authorise recurring charges for your selected plan.

• Subscriptions renew automatically unless cancelled before the renewal date.
• You may cancel at any time through your account settings. Access continues until the end of the paid period.
• Refunds are not provided for partial billing periods, except where required by applicable law.
• We reserve the right to change pricing with 30 days' notice by email.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulation.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Upload or transmit malware, viruses, or any other malicious code.
• Use the Service to store or transmit infringing, defamatory, or otherwise unlawful material.
• Resell or sublicense access to the Service without our prior written consent.

6. Your data

You retain ownership of all data you submit to the Service (“Customer Data”). You grant us a limited licence to store and process Customer Data solely to provide and improve the Service. We do not sell Customer Data.

Upon account termination, we will retain Customer Data for 30 days to allow export, after which it will be deleted except where retention is required by law (e.g. accounting records — 7 years). You may export your data at any time through the account settings.

7. Intellectual property

The Service, including its software, design, trademarks, and content, is owned by Now-Next and protected by applicable intellectual property laws. These Terms do not transfer any ownership rights to you.

8. Availability and support

We aim to provide high availability but do not guarantee uninterrupted access. Scheduled maintenance will be notified in advance where possible. We provide support via email at contact@pilot-next.com on a commercially reasonable basis.

9. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement, to the maximum extent permitted by applicable law.

10. Limitation of liability

To the maximum extent permitted by applicable law, Now-Next shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising out of or related to your use of the Service, even if advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the total fees paid by you in the 12 months preceding the claim.

11. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your access immediately if you breach these Terms or if we are required to do so by law. Upon termination, your right to use the Service ceases immediately.

12. Changes to these Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of Ireland, without regard to conflict of law principles. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Ireland, unless mandatory consumer protection law in your country of residence requires otherwise.
